Islamic Shari’ah encompasses rules and laws that surpass conventional reasoning in order to promote the well-being of individuals and society as a whole. Implementing these laws not only leads to prosperity, security, and development in worldly life but also guarantees benefits in the afterlife.
One aspect of these laws is the criminal legislation of Islam, known as retribution, limits, and ta’zeer. By enforcing these laws, social justice and security are established, effectively deterring crimes.
An important objective and wisdom behind implementing limits and retribution is to safeguard fundamental human rights, including religion, life, intellect, lineage, honor, and property. For instance, apostasy is limited to protect religion, qisas is enacted to safeguard life, prohibition of alcohol consumption maintains intellectual well-being, laws against adultery and fornication protect lineage and reputation, and theft laws safeguard property.
Another goal and wisdom lies in shielding society from the destructive impact of rampant crimes. Those who commit social crimes are like germs; if left unchecked, they spread and affect other parts of society. Similar to how healthcare professionals remove a cancerous organ to save the rest of the body, implementing punishment serves as a preventive measure.
Additionally, applying the principle of qisas eliminates the grave issue of killing within the human species, preventing internal conflicts and animosity, ultimately leading to global peace and stability. When qisas is implemented, the murderer understands that by killing someone, they are essentially killing themselves, thus preserving all lives. This wisdom is mentioned in the Holy Qur’an:
Translation: “And there is life for you in retribution, O people of understanding.”
Reformation of the criminal is another wisdom and benefit of implementing Sharia penal laws. By witnessing the pain and punishment, individuals are deterred from committing future crimes.
The establishment of justice and fairness is also an outcome of implementing these Sharia rules. If someone unjustly takes another person’s life, their own life is taken to ensure justice.
Muslims should view the application of Sharia limits through the lens of Islamic teachings rather than being influenced by negative propaganda from Western media and organizations. By doing so, societies can achieve stability and prosperity.
