The implementation of Islamic criminal laws contributes to social stability and the well-being of individuals and society as a whole. These laws, which go beyond conventional reasoning, aim to ensure prosperity, security, and development in worldly life, as well as guarantee benefits in the afterlife.
Islamic criminal laws, including retribution(Qisas) limits(Hudood), and ta’zeer, play a crucial role in establishing social justice, security, and effectively deterring crimes. They are designed to safeguard fundamental human rights such as religion, life, intellect, race, honor, and property.
For instance, apostasy laws protect religious freedom, Qisas (retaliation) laws safeguard personal safety, laws against alcohol consumption protect intellectual well-being, laws against adultery and defamation protect racial and reputational integrity, and laws against theft protect property rights.
Another objective of implementing these laws is to shield society from the destructive impact of rampant crimes. Similar to a cancerous germ affecting multiple organs, social criminals pose a threat to the overall health of society. By applying retribution and limits, these individuals are effectively removed to preserve the well-being of the community.
Furthermore, implementing divine retribution helps eliminate the grave problem of interhuman killings, thereby preventing internal conflicts and enmity. This contributes to global peace and stability, as the murderer is held accountable for their actions, saving countless lives. This wisdom is mentioned in the Holy Qur’an.
Additionally, the reformation of criminals is a significant benefit of implementing Sharia criminal laws. By witnessing the pain and punishment associated with their actions, offenders are deterred from future criminal behavior.
The application of these Sharia rules also establishes justice and fairness. For instance, if someone unlawfully takes a life, the punishment of capital punishment ensures justice is served.
Muslims should perceive the application of Sharia limits in light of Islamic teachings and not be swayed by external opinions. When properly implemented, Sharia criminal laws significantly reduce crime rates and uphold justice in society.
