Courts of the Islamic Emirate, key factor for Peace and Solace among the People

In a time that the Islamic Emirate of Afghanistan has been continuing its Jihadic efforts against the current occupation and obtaining significant gains, it has concurrently  established Shariah-based courts for resolution of civil and criminal cases of the people. Especially in areas under the control the Islamic Emirate, all three courts i.e the primary court or the court of first instance, court of appeal and court of Cassation are functioning. People have expressed their contentment and satisfaction regarding this step of the Islamic Emirate because they practically see their issues being resolved swiftly and transparently.

Currently people take their cases to the courts of the Islamic Emirate instead of the Kabul Administration. Even from cities and areas under the control of the Kabul Administration, people take their cases to the courts of the Islamic Emirate. There are examples of personnel of the Kabul administration hailing from the capital city Kabul taking their cases to the courts of the Islamic Emirate and having them resolved there. They know that in the courts of the Kabul administration, everyone without money and favoritism based on partisanship and nepotism is not heard nor could they expect justice. The reason is that the aim of the government officials is to fill their pockets. But the officials of the Islamic Emirate do their job with the intention of jihad. Their goal is to obtain the pleasure and blessings of the Almighty Allah. As this point is mentioned in the following sayings of the Holy Prophet (PBUH):

“The most beloved people to Allah are those who are most beneficial to the people. The most beloved deed to Allah is to make a Muslim happy or to remove one of his troubles, or to forgive his debt, or to feed his hunger. That I walk with a brother regarding a need is more beloved to me than that I seclude myself in this mosque in Medina for a month”. (Quoted by al-Tabarani)

The officials of the Islamic Emirate are living among their people and are easily accessible. It is clear that if these courts did not exist, many internal problems among the people would have led to bloodshed and enmity. Furthermore it would have created an atmosphere of fear, oppression and intimidation among the people. We have many examples of such horrendous incidents during the past few decades. Even now we see robberies taking place in broad day light in big cities of Afghanistan, kidnapping children and even cutting their body parts or killing them if the victim’s family refuses or is unable to pay ransom.

Recently reports were published in the media that such crimes are carried out in police uniform that has given rise to ubiquitous fear and concern among the countrymen. There are evidences that these groups are being covertly supported by government officials and is the reason that the crimes rate is on the increase instead of decline.

It is a reality that the believing people of Afghanistan are suffering from many problems. The Islamic Emirate could not resolve all of them in the present war situation. But we can say that despite the current fighting, the Islamic Emirate is a factor of peace and stability among the people in the country and has created an atmosphere of relative relief and calm for the people. The Islamic Emirate will continue its service with the cooperation and support of the people if Allah, the Almighty wills.
